I know how the case has been in England. The In
the time of the Tudors, the Courts of law Justice remained
the Courts of Common-Law as they are now termed
in contradistinction to the more modern Courts of Equity,
remained what they remain still, and will remain
so long as one stone of their present fabrick remains
upon another, radically unfit for the purpose of justice. In
such a case like this it is tolerably easy to see that
a bad system is a bad one, it is not altogether so
easy to see in what the badness of it lies. When business goes on all in one set of hands, a natural enough consequence is a wish to change them. Talking about Courts of Justice Says
the King one day to his Chancellor, I can not tell it is not written
exactly what King nor what day nor what Chancellor,
"These people make sad work of it, do you
take the matter in hand and see what you can
make of it. do with The Chancellor did as he was bid: and
accordingly gave out, that if people would come
to him when they wanted redress in certain cases
instead of going before the old Courts of Justice who which
would they give them none, they might find their
account in it. The ware which those men in
scarlet-robes and fur edgings deal in, and which
they call Justice you find is good for nothing. does not suit your purpose.
I have invented a better sort of ware which will
suit you to your heart's content, and which I call Equity.
