Accommodation not by your wealth to obtain an advantage which
is not your due: your chances are equal: meet
him half way or if you prevail you shall
still bear all your own costs, though if you
fail you shall bear all his. He might hold a similar language to a rich defendant entrenching himself behind his wealth. Whether a
Court of Justice ought to be intrusted with
such a power is not here the object of enquiry:
but Courts of Justice are intrusted with
greater powers: and this is what a Court of
Justice might be allowed to do towards accommodation,
and what no Accommodation-Office
could do without being a Court of Justice
without departing from its name.
