The acquittal of a defendant is therefore no sort of
disparagement to the Judge by whom he was committed.
In England where when the acquittal of a person tried
for felony at the gaol Jail-delivery is acquitted
whoever thinks the worse of the Justice of Peace who
committed him or what Justice of Peace ever felt
the smallest sollicitude on any such that account? Yet in
England half at least of the persons committed in such
case are acquitted, not that they are innocent, but
that the numberless defects in the law do not admit of the conviction of any larger share. He is to
remain with
favorite maxim with those who have
most on the side of the defendant in criminal cases,
is that no man ought to be presumed guilty even
of an ordinary offence of the kind of those which
are known in general to be most frequent. This
argument has for its sole ground a presumption that
a man man acting in an elevated office
will commonly be guilty of a species of crime
which happily as rare and unnatural as it is
obvious.

Nor is this all. The disposition to most this most
obvious species of injustice, however determined, will
after all find itself ineffectual without the assistance of such a mass
