to take collect and record it if thereto required on either
side.

1 Uses of a record The uses of taking the record of a cause are
1. To serve as a check upon security for the probity diligence
and attention of the Judge.
2. To furnish data grounds of judgment in case
of an appeal without the trouble and delay of a
fresh examination.
3. To preserve evidence against future occasions.
4. In cases where the sense of the law comes in question, to
serve as a guide to future judgments, or to
afford grounds for corrections to be made in
the tenor of the law by the legislator.

2 What it ought to contain In a record ought to be contained
1. A memorial of the several allegations made and of all other steps or proceedings
taken by the several parties in the course of
the cause.
2. Reference to the several any written allegations
and or pieces of written evidence that have been
exhibited.
3. Minutes of List of the witnesses that have been
examined on both sides with minutes of their respective
examinations.
