6 The original if the record is a copy may be transmitted in the first instance In cases where the Judge is required to transmit
the record for the information of the Court of
above whether of concurrent jurisdiction or of appeal
it lies in his option whether to transmitt in the
first instance the rough copy du original or a
fair copy or extract, 7 Copy how to be taken in which latter he may
if he think proper omitt any such passages as
appear to him to be immaterial: but notice shall
be given in the copy of every such omission, shewing
by marks lines and dots how many lines in every page and
how many words in every line are omitted: |||....
8 The original always upon requisition. and the original draught shall be always at any time be transmitted
if required on requisition by the Judge above.
9 Cases in which record may be destroy'd. Where it is plain that the preservation of a
record can answer no useful purpose the taking
of it may be omitted, or if taken it may be destroy'd
by consent of parties, testified by their
signature. In such cases nothing more shall be
preserved but a memorandum of the cause in
the registry and at the end Destroy'd by consent of
parties witness our hands [or marks] A. P. Pursuer
A. D. Defendant A. J. Judge.
