Jurisdiction The concurrence option of jurisdiction here given to
Judges within the territories of neighbouring Judges
has two objects in view; the convenience of the
suitor and the infusing a spirit of emulation
among Judges. Their afte Extent of jurisdiction
adding nothing to their emolument any exertion
they a Judge may make out of the necessary sphere of his
duty will not be liable to subject expose him to the mortification of seeing his to him to the

It may be a salutary spur to exertion and circumspection,
if a Judge observes should observe the inhabitants of his
own territory preferring giving a conspicuous preference to the arbitrage of a neighbouring
Judge Magistrate.
The going out of his territory must be in great
measure be left optional on the part of the Jud Judge:
if it were not, the inhabitants of his own territory
might have to wait for justice.
The purity of conduct so conspicuous on
the part of the superior Judges in England is
supposed to be owing may be ascribed perhaps in some measure to a
sort of perfectly decent but not altogether imperceptible
emulation, which could not be have
substituted but for the intercommunity of jurisdiction
that subsists amongst them to so considerable degree.
