Appeal
VI Quot Thouret But what gives the finishing stroke to all
distractions on the ground of importance, is the
absolute non-necessity and thence the utter iniquity
of denying the benefit of appeal to the least
important cause that can be conceived. The necessary
expence of appeals we I have shewn may
be reduced to nothing. I have left it no man's
interest, no not even taking the gratifications of caprice and obstinacy into the account
as they it ought always to be taken, into the
account of interest, to venture upon an appeal
in a cause of too little importance to deserve it.
I have thrown it Without forbidding even the
most frivolous appeals, for appeals till they
judged of it is impossible that an appeal can
be known to be frivolous, I have thrown the
whole burthen of the inconvenience upon him who
causes it. After this, what pretence can there
be for refusing excluding appeal in any imaginable
case whatsoever, upon the ground of
prejudged frivolousness?
