Appeal
Quot Thouret The rage of this unhappy prejudice against
equal justice has not yet satiated itself. was
have another invective against it attack upon it equal justice is yet to come.
"Ascertain the condition a suitor has been left
"in (says M. Thouret p. 20.) who has pleaded in
"appeal before a Superior Court, or even before
"a Praedial Court, for a property of the value
"of 10 livres a year, or for a capital to the
"amount of 250 livres. If he has lost his cause,
"see if he has not lost three or four times the
"worth of the object of in dispute: if he has won,
"see again whether it be true that he really
"gains the value of the property that has been
adjudged to him. You will therefore afford your protection
"to the interest of the individual, by refusing appeal
"in all cases where, by reason of the object in litigation
"the pretended benefit of it is but an illusion illusory, if it be
"not absolutely ruinous: and the greater latitude you
"give to this part of the ground work basis of the judicial establishment,
"the greater measure of simplicity it
"will be in your power to give to the general
"system." — Thus far M. Thouret.
