§ 3 3 A witness is still as such the fittest prosecutor Still it is manifest that where no particular
ground of unfitness can be found, happens to have place no person
can in the first instance be so fit to take upon
him the function of prosecutor can not in in the
first instance be there no other person can
be found to him whom the function of prosecutor
appertains so properly at least in the
first instance, as one by whose testimony the
charge or other claim is to be substantiated. The
witness from whose information all that is to be declarations all the information intelligence
collected known about the matter is to come can just
as well go and tell it of his own accord without being called by any
one, as in consequence of his being called by
somebody else, who but for him could neither have
called for him, nor so much as known any thing at all
about the matter. This being the case why
look or insist require why so much as wish for
any body else? why multiply agents without necessity?
4 No use Inconvenience in lodging in different hands the two offices. 1. Jud No other person with equal confidence A forcible separation of the two characters can
not be attended with the smallest advantage.
And it has one manifest bad consequence. It is
