and without use. The motive that finds the least
favour is that of gain. Suppose it certain, as
in many cases it may be, that the prosecution has
this for its motive and no other. for its motive Is the fate of the defendant
at all to be influenced by the discovery? Ought he
to be acquitted or to be discharged so much as from
the smallest particle of the punishment? What are
we to think then of the laws which hold out this
motive and no other to invite prosecutors, and trust
their whole chance of getting executed to its efficacy operation
their whole chance of efficacy for getting executed? Were Proscribe
this to be the case there ought to be no such this motive, and you forbid all actions
thing allowed as an action for damages in case
of a private injury.

Of all the motives that ever concurred in to the
production of producing a prosecution for an offence of a purely public
nature, public spirit is the only one that would
not be made use of as a ground for producing
shewing favour to the defendant, the only one
which the prosecutor would be forward to avow.
The existence operation of this motive is sure to be denied
in every each individual instance, and men who think
themselves and wise and to pass for and to shew possess a superior knowledge
of human nature are during its very existence its
faculty of operating in any case during the very
existence of such a principle. in man's nature
Coupling this theory with the leaning in favour of notion of discouraging
the defendant in all cases when the prosecution is prosecution
