Tit. V. Ch. VII.
§ 3 English ten or even twenty pound will not ensure a man
absolutely so much as against the difference between the costs out
of pocket and those the costs allowed. What if
no costs are allowed at all? This is the case in
many instances where no other mode of procedure
is allowed than that the regular that is the unnecessarily
expensive and in every respect the bad one.
In all such cases In this in the case what then is the effect of the pretended
dis encouragement? pure discouragement and nothing
else. The proffers of the law made by the legislator are a vile trap laid
for the good faith of individuals. Cheating them
out of their services he at the same time steals from
them their good name: and displays in his own
conduct that iniquity which in others he punishes devotes to
ignominy and that deservedly with an equominious punishment
