When the instrument the instruments of the supreme power refuse to
do their duty, where is its authority unless it
compels them? Till they refuse to do their
duty, to what purpose do it for them? From
the opposite errors result different mischiefs:
impotence in the one case: impotence, in the other. waste of time in
the other.
If the House of Commons had made a
little less use of their memory and a little
more of their reason, they would have turned
over the cognizance of Election-causes to other
hands here reserving in the first instance,
reserving their Committee for Appeals. The
judgments appealed from, one might safely
venture to promise would not be one in ten,
and in that tenth one not more than one part
out of a hundred of the transactions conduct of the
judge would be disputed. the objections would
not embrace one hundredth part of the conduct
