Suret It is natural that the same cause should
frequently be found to belong to both these
classes. Among the incidents sources of difference disturbance which are liable to
breed disturbance in the space of in families, there is can be no one
more frequent none more productive than the appearance of some
act which is looked upon as a trespass against
the laws of chastity or modesty , or of that species of prudence
which has its foundation in those laws.
One objection which has been already
alluded to deser demands an answer. The maxim
upon which all free government is founded, the
maxim the thruth of which you yourself all along
appeal to or tacitly assume is that the pub
whatever is the will of the people ought to be
law, and that public opinon is the only practical
test of truth. How is this mission to be reconcileable
with the wish in any instance to withdraw
the conduct of individuals from the censure
of the public age? If the opinion of the public
be the standard of propriety as well as the safeguard
of virtue, how can any punishment which that
tribunal desires and inflicts be justly and consistently be deemed justly laxed with exorbitancy. excessive.
