Of the (purposes) of Procedure

painful than the artificial one put in practise
by the law. The great alleviation of the suffering
that attends a natural death, is that the time
of the catastrophe is most commonly uncertain to
the last: according to the common proverb, while
there is life, there is hope. Besid Moreover the
catastrophe is commonly preceded by some disease
which the longer it lasts, and the worse it is, renders
life the less desirable. Neither of these alleviations
applies to a penal death: so that here the
pain of apprehension rages in full force. If there
be a case in which the pain of apprehension
adds nothing to the total of the punishment, it is
where the punishment is purely of the chronical
kind: where there is nothing to be apprehended
but a severe course of punishment or
confinement, such as during the whole of its
continuance is as to be filled up with a series of sufferings,
of which while his fate remains in suspense
he has no experience. Even But even here it may
happen that imagination shall be more powerful
than reality: and that the pain of apprehension
shall be greater than the pain of sufferance.
