Of the (purposes) of Procedure
The system of Procedure is a phrase used
for shortness instead of saying, the system of
steps taken or required to be taken in the
course of judicial procedure. The system
of penal procedure is a system of operations directed
to a certain end: viz: the punishment
of (such persons as prove to be) delinquents: and
in some cases, the prevention of any such
future mischief as may seem to be apprehended from
the delinquency of such the
intention of offending has become apparent: in
other words to the execution of what is required to
be done to particular persons or particular things
by the substantive branch of the law, in the view of
preventing any such mischief as may come to
be apprehended from the delinquency of such persons:
to give effect to the laws that belong to
the substantive branch, and cause that to be done
(in relation of offenders) which they declare shall
be done, and that not done which thus declare
shall not be done.
