Judges – Number

of his intellectual, partly upon that of his moral
qualities. His intellectual qualities again will depend,
because those of every man depend, in a
certain measure upon his moral: and it is only
in so far as this dependence subsists, that the
state of the former his intellection qualities are within
the reach of the influence of the law.

The qualities of both sorts on which the
rectitude and promptitude of decision on the
part of a Judge depend may be comprized under
the following heads: three heads: 1. probity: 2.
exertion: 3. skill or intelligence.

Probity, on the part of a Judge, depends in
great measure on his the strictness of his dependence subjection
to the power
on public opinion His in great measure: his reputation
for probity, altogether. Of the two his actual probity
and his reputation for probity, in as far as they
are capable of differing of existing separately, his
reputation for probity is the object of superior importance:
for on his real probity depends only
the real security of the people: on his reputation
for probity depends their sense or consciousness
of security.
