Judges – Number
Where there are more Judges than one, in
the ordinary course of things, one some one of
them under some such name as that of President
does all the business: the rest are but lookers. all that the rest do is to look on.
On the part of every such supernumerary In these supernumeraries In them a consciousness of inutility inculcates a habit
of blind acquiescence: While on one hand they blind
his diligence by a false display of assistance, on the
other hand they give his opinions an a degree of weight
with the public more than properly belongs to them by a fallacious
appearance of concurrence.
A case still worse than that of the nullity of
all beside the President is where they happen to split into
parties. In that case there will be two efficient
men the President trains of cyphers, and two
efficient active men the President and the head of the
party that falls into opposition against the President.
This state of things in along recompence for a very
small encrease in the measure stock of intelligence,
introduces a great measure of delay and other
mischiefs of which a little farther on which I
shall come to presently. The delay encreases,
while the reputation of probity, and but too naturally
probity itself diminishes.
