Judges – Number
7. Numbers are not less unfavourable to
skill and intelligence, in as far as these pro
qualities are the fruit of industry. True it is
intelligence is not so exclusively the fruit of
industry, but that diversity of intellige intellect
may augment the stock of it. Though in two
Judges you will not get a measure of intelligence
double to what you would have got in one
yet you may get something more; and so for with regard to
any greater number. But whatever benefit advantage
assistance may be derivable from this source will
not begin to tell as of any efficacy untill
that which may be expected from the Advocate
on both sides and that which may be expected
from the right of appeal repeated as often as
shall be thought necessary are both exhausted.
But from a man in the station of an advocate
much more exertion from very obvious
causes may be expected and thence much more
intelligence than from the same man in the
capacity of a Judge, much more than in the
capacity of one of a multitude of Judges.
