Judges – Number
sitting singly in his court tell on all accounts
as two Judges, whereas in the same Court they
would on all accounts but one tell for less than
one. For which if in If an Appeal is not sufficient,
you may have another: and neither
the one nor the other is heard cast unless⊞ ⊞ except in the few cases in which occasion
is thought to call for it: whereas when you add
Judge to Judge in the same Court, there they
sit on for ever and are must be paid for ever wanted or not wanted.
Nor is there anything to hinder a Judge if
intelligence should be thought still wanting, from
calling in and the opinion or suggestions of an
Advocate unconcerned in the cause, or any
other by-stander. If after passing through all
these trials sieves error should still remain, the
frequency of such an incident can hardly be
such as to render it worthwhile to pay at any
very extraordinary price to prevent for the chance of preventing it, much
less by such precarious means: the procedure
an error which cannot be found out by
three tier ranks of successive advocates and as many tier ranks of
Judges successive Judges besides chance assistance
is not by in any great danger of being
discovered by the people, nor if discovered of
making any great impression: it is not likely
to be of any very heavy prejudice either to the
sense of security or to security itself.
