Judges – Number
To this expedient which in England is frequently recurred to in England
there is nothing to object to but the Delay and the expence. There is no
use in the publicity being put into possession of an opinion which in
the author's own judgment turns out upon maturer consideration to be erroneous.
Two usages connected in the English practice
with that of adjournment on this ground are not
equally irresponsible: one is that of adjourning
from term to term that is from quarter to quarter
for the sake purpose of effecting an unanimity: the other
is that of giving up an real opinions that the
declared one may appear to be unanimous. In
the former case a denial of Justice takes place Justice is denied, and that for
months or years, and the rights of the suitor are
sacrificed to the variety of the Judge. In the other
case truth and honest are violated, that the
opinion of reputation of the body may be kept
up by false pretences, and the notions of a
part of that body be received with a degree of
deference which is not their due: due only to
the whole. It is a sort of judici obtaining
credit upon false pretences: a sort of judicial
swindling.
