Judges – Number
In both we may observe the licentiousness of
voluntary absentation non-attendance and the species of corruption which
it covers licences raging without controul: and in the
exercise of a that unsuitable part of their ordina authority which
though legislative in name is in reality more of a
judicial nature, we may see attendance favour
under the name of attendance openly sollicited by
printed cards.
But though fifteen impermanent occasional Judges are
be found better than five hundred and fifty eight
permanent ones, fifteen permanent ones are found
too many not only for expedition assiduity and
intelligence but even for probity. It is no secret
among Scotchmen that the fifteen Judges who compose
by whom the sovereign tribunal of Scotland
is composed have not given that constant satisfaction
which is given with by the single Judges
and by the fraternities of four Judges that compose
the Courts of parallel authority in England.
