Local knowledge too is indispensably necessary in legislation;
and the local knowledge that can be expected in an individual
lies within a very limited sphere.

But the effectual security against despotism on
the part of the judicial power, is the dependence
of the highest judicial tribunal upon the legislative
body which is itself under the dependence of
the people. I repeat it: you have no liberty
and useless Liberty is but an empty sound
any farther than except in as far as every power in the State
is dependent in some way or other on the will
of the body of he people. From the idea of
three independent powers termed the legislative,
the judic executive and judicial I can collect
noth no other alternative but despotism or
anarchy: despotism in as far as each acquiesces
in the proceedings of the other: anarchy in as
much they attempt to interfere with and controul
each other.

To what purpose make laws, if those
whom you trust to for executing them refuse
to do so? and what should hinder their refusing them, if you
yourselves abjure the power of punishing them
