Judicial Establishment
Note to Tit. VIII. art 6 & 7.
Were a provision to this effect to be adopted, further
details would be requisite respecting a declaration
to be made by the Judge of his connections, and the
mode of choosing distributing the new departments upon the
annual migration.
It remains to be determined whether the security
gained by this institution would pay for the
trouble, discomfort and expence.
To the Sub-department Courts it would on
those accounts be plainly inapplicable. Neither
would it be equally necessary in that subordinate
station. Parity or the so near the fountain head
will be sufficient to ensure the parity of the inferior
branches. It would be to no purpose for corruption to
hazard a false step when it was sure of meeting which it was sure would meet
with correction from above.
The connections above specified are material
not so much on their own account, as on account
of the presumption they afford of a circle of friendships
and enmities.
After all the security which this institution
can afford is of small importance with that afforded
