Of Taxes in Law Proceedings

The object of this chapter under this title is not to specify what
ought to be the taxes upon law-proceedings: but
to prove that there ought to be no such thing. In Under
this title
this chapter accordingly with there will be no text:
it will consist wholly of observations.

The tax upon law proceedings adjusted is
in every respect the very worst kind of tax that ever
was invented. It possesses Taxes of this kind possess in the highest degree almost
all of the bad properties from which it is
orought to be the object of the contrivances of taxes to keep them free.
And of these for any which it does not possess, yet

1. They are unequal: in other words disproportionable
to the abilities means of those from whom they are exacted
or attempted to be exacted. As they are nearly
the same whatever be the pecuniary circumstances
of the party, they are fr relatively heavier upon the poor than
upon the rich. As there are some men in almost
every state who are at best more than a thousand
times as rich as others, these taxes are may be a
thousand times as heavy on some people as on
others. But the poorest class of people is by far
the most numerous. The number of those who form people as who compose
the poorest class are more than as many
as all the other people of the nation the people of all the other classes put together.
Whatever therefore so as it be not the single poorest to be the class the the circumstances
of which a tax of this sort is adjusted, the people on
whom it is exorbitantly heavy will be beyond comparison
more in number than those on whom it is
unnecessarily light.
