2. It is unfixed uncertain. The reasons why a tax ought to be
certain are two. 1. That the possessor person on whom the quantum of it imposed on each contributor depends may not through
[through partiality or corruption for lucre] have it in his power
to render it unequal, that is more in portion on
some persons of the contributors than it ought to be. 2. that whatever
it be upon any one given contributor he may have
it beforehand and be prepared for it.

With regard to other Taxes perhaps every other tax that is liable to the quantum of which
is left to be adjusted
depend upon any other
person after the Legislator
has done what belongs
to him towards
taxing it, with regard
I say to every other
such tax.

The person on whom the quantum of them it
imposed on each contributor depends, is the possessor:
the public officer or officers whoever he or they be whether
appointed whether by the government or the people,
to whom this business is committed. Now then, as
in this case the business of adjusting such quantum is not entrusted
to any such officer or set of officers, but
is performed in the first instance by the Legislator
himself, it might seem at first sight that there was no
room for it to be subject to inequality from any
such cause. And true it is that as to any inequality
which might be produced by a breach of
duty in any such officers, this tax is at tolerably
free, since in this case there are not any strictly speaking any officers whose
precisely function is precisely of this nature: though officers
there are whose function is very near of him to it
as will be shown presently.

But the point is not by whom nor in what
manner such inequality is liable to be occasioned
but whether it be liable to be occasioned by anybody, and if it be
