Of Taxes on Law Proceedings
with what probability, and to what amount, and
when inequality is liable to be occasioned, the only
case such inequality is mischievous to individuals or where by means
of it the tax is augmented by made to sit heavier on some person
than it ought by the Legislator it was meant to do.
But this tax is not only liable to be but
almost sure of being rendered made to sit heavier not
on some person only on other persons than by
the legislator it was meant to do: and that not
on some persons only but on all persons.
If there be anybody by whose means this tax be liable to be made excessive,
by any bod it matters not in what way that effect
is liable to be produced. Now It is not indeed in the
power of any body to say on any given occasion
to this person you shall pay so much, and
to another person so much more. But if there
be in the power of an body a certain thing to the quantity of which the quantity
of the tax is by the Legislator made proportionable,
and it be in the power of another man
to cause you to have and that thing to be in
a greater quantity than there is occasion, or to multiply if
the occasions on which the tax is levied be
such as it is in the power of any such man to multiply,
it comes to the same thing.

taxes on Law proceedings are made payable are
1. The exhibiting or taking copies of certain writings
which are necessary to be exhibited or copied by
one or other of the parties in the course for the maintenance of their several
allegations:
