It comes unexpected
The An other inconvenience arising from the uncertaintythat may alter a
of the tax for want of its being fixed, is
that it is apt to take a man unprepared. Now
this is the more particularly the case with this kind
of tax than with any other. In most cases the
event from which the obligation on a man to
pay it results, comes upon him as sudden
and as unexpected as it is possible for an event
to come upon him. Who for instance can
prevent that on such a day a man will beat him or rob
him or prosecute him unjustly for either of
those crimes.
Even when the principal event, the event
which has made it necessary for him to institute
or defend a prosecution, has happened,
he is far enough as yet from knowing the amount
of the burthen he has to bear. That burthen
as we have already had occasion
to shew, is liable to be more or less enhanced by
the rapacity or unskifulness of the lawyers of
both sides, and by the litigiousness of the adversary.
It is liable also to be enhanced without
any such fall misbehaviour, by the death of
parties or witnesses, the
