Of Taxes on Law Proceedings
and in short by the indefinite variety of accidents that are
apt to intervene in the progress of a cause] in
the course of a cause are apt liable to intervene
in such manner as to encrease the number
and enhance the chargeableness of the steps
to be taken and the writings to be exhibited.
Another property which to be wished for
in a tax is that in point of time it should be seasonable.
It should come upon a man at a time when
he is at least as well able to bear it & if
possible when he is better able to bear it, as
at other times. But there is no tax which is
so particularly unseasonable as that on Law
Proceedings. It [causes &] galls [him just at the time that
he is] those who are already sore. Because a man has already
suffered one injury in his person, his
property liberty his reputation, or his or his fortune it makes him suffer
in the same manner as he would suffer if he had
received another injury. It watches the occasion
when he is least able to bear, and then lays on the
burthen. All other taxes are taxes upon prosperity:
this alone is a tax upon distress misfortune.
