Evidence Note

Leading and discrediting
17
Discrediting may
two different
effects corresponding
to the different endeavours:
1.
and destroying it.

Under the term discrediting may be included two
perfectly different operations or rather endeavours, proceeding
from two different opinions or views respecting with regard to the veracity
of the witness. In many cases the object will be only
to shame back into the path of truth a witness whom
you think you see deviating or either disposed to deviate from it.

In some the object may be to shew to the audience
that he has already deviated from that path it, and that so
grossly, as to have placed himself out of reach of repentance correction
and to have forfeited all title to be believed, as far as
the credit of what he has said is affected by his
disposition to violate depart from it it to your prejudice.

The former of those two endeavours will naturally be the primary one: endeavour:
as since it is better for you that he your witness should say something that
is to your advantage than that he should say nothing
but what is to your disadvantage, even though in the latter case you should
succeed in getting him to be disbelieved.

As the former is the more commonly the first primary
endeavour, so it is it probably the case which it supposes
and hopes for, the more common case: the opinion
which is the more favourable one to human nature seems
in this instance the more just.

In the first case to speak explicitly and correctly
instead of saying or attempting to descre-
