mischiefs instead of being ascribed to those
real causes the imperfections of the system
of procedure are imprinted ascribed to the nature of
things that justice very frequently fails of being
done is a truth too palpable to be disputed
too palpable to pass unobserved or unacknowledged
but the notion is that whenever it can be done
to its acme thus if in any case it fails of being
done it is because in that case in the
nature of things it cannot be done and upon
this supposition the in this system
remains entire in a manner entire—as entire
as if its title to that confidence were ever
so real and indisputable.

As enquiry advances it will be perceived
that in England under the English law the system of
procedure law teems with innumerable imperfections:
what at the same time is seen—seen by every body—
and without enquiry, is—that spite of all
those imperfections that same system of procedure
fails not to command a most preeminent
degree of confidence. In the course of the enquiry
& will at the same time be seen that this confidence
is by no means without cause, by no means
without just cause, and what those causes are
will at the same time be indicated.
