Use of the above
list of ends a
criterion for all
laws of procedure —
the source of all
principles and
reasons for such
laws

If the enumeration made as above of the
several objects proper to be aimed at in the character
of the ends of procedure is proper as far as it goes
& compleat, the several ends will furnish so many
principles by which the propriety of every regulation legislative provision
proposed in the character of a leg regulation of procedure
may be tried: they will may be considered as constituting
so many sources of the several subordinate reasons
which for the purpose of indicating the necessity
or utility of such provisions respectively may come
to be adduced.

till a mischief can
be found which
arising out of the
course of procedure
can not be ranked
under any of these
heads.

Should any consideration present itself which
operating serving in the character of a reason to evince the
utility of the provision to which it is thus applied
shall at the same time appear incapable of being
ranked under any one of the above principles in
other words though good in itself i:e: serving to
evince the utility of the provision in some other
respect it should be found not to be of a nature
to evince the subserving of the provision in
question to any one of the above ends in such
case the enumeration of these ends — the enumeration
of the corresponding principles — will in so far turn
out to be incompleat on the contrary if no such
independent reason be to be found it follows that
in this single chapter is contained a test by which
the propriety of every imaginable provision of
procedure may be tried and determined. — And in
this case the pains taken to in the investigation of them
and in exhibiting the nature of their relation to each
other will not have been ill-bestowed.
