What there is of novelty

in what is delivered
concerning these ends
1. Bringing them together
at the start to
serve as first principles
2. Explaining their
relations to each other
3. Employing them as
tests, and the only tests,
for judging of adjective
laws.

The fact is that in the enumeration of them
there is little if any thing new: a book on a
subject of procedure is perhaps hardly to f to be
found in one part or other of which the mention
of them all in one way or other does not
occir occur — what then is of novelty in the use
here made of them consists — 1st in the collecting
them all together and setting them down at the
beginning of the work 2ly in indicating & explaining
the relation they bear to each other and to the
general principle of utility 3ly in the holding them up to
view as tests and as tests of the propriety not
only of this or that particular provision but of
all provisions whatsoever which on the ground in
question can come to be proposed —
