§. Testimony, how procurable

In every such Testimony-requiring
Mandate
will moreover
be inserted the warnings
following.
1. Warning of the burthensome
consequence
of non compliance
2. Warning of the burthensome

of falsity in several
shapes.

has applicable property.

Warning of suspicion
of delinquency.

But to pursuer, evil
from non attendance
of witness may be the
same as in the opposite
case.

In general, more
convenient to accept
of epistolary response
than to send for oral
examination to distant
judicatory.

Epistolary testimony
eventually confronted
with oral.

On reiterated enquiry,
accersition of witness
on suspicion
of mendacity.

So even on original
enquiry.

Cases for preferableness
of epistolary over
oral Testimony
1. Fact solitary.
2. Fact simple.

Exceptions excepted,
compulsion not remuneration.

Reasons
1. By remuneration,
a tendency to produce
false testimony.
2. Reliance on it not
so strong as when procured
without remuneration.
3. Waste of money.
4. Corruptive tendency.

Exceptions
1. Where remuneration
appointed by law.
2. Remuneration
appointed by express
ordinance on individual
circumstances.

No action producible
without impelling
motives, counterballancing
restraining motives.
14.
Cases where need of
such motives.
1. Suit simply requisitive.
15.
Though compulsion
employable, yet the
evidence may not
be elicitable without
remuneration.
16.
Where compulsory
mode employed,
compensation to be
announced or delivered.
