Ch IV Arrestation for Debt.
1.
Debt but one of several
purposes of arrestation.

Of arrestation, the
effect, imposition of
a burthen on arrestee.

No burthen should
be imposed by under
expectation of
preponderant
benefit.

The burthen being
certain, the benefit
uncertain. Whoever
desires to impose the
burthen on another,
must satisfy the Judge
as to the probability
of preponderant benefit.

If the preponderant
benefit secured, that
part of the benefit remains
net and pure.

If grounds of arrestation
do not appear
sufficient to the Judge
adequate satisfaction
should be secured.

But as the propriety
of arrestation depends
on each individual
case — all fixation
in this respect shd
be established.

In summary mode
in criminal cases no
justifying circumstances
ascertained.

In Civil cases in
English and French
Codes this precaution
not taken.

For this omission
justificative cause
none.

Efficient cause there
is.

Arrestation at the
commencement of
the suit.

Burthen demanded
of Defendant by Plaintiff
may be in any
degree light or heavy.

Needfulness of arrestation
established
on evidence.

But in most cases
no such evidence
but that of the party
demanding the service.

But under most
Codes, personal appearance
not required
at first.

For this arrangement
no justificative cause.

Under natural system,
every thing done
by parties for themselves.

Under technical,
nothing done by parties
for themselves.

In England, the exclusion
effected in
silence.

In Bonaparte's Code
the exclusion openly
pronounced.

Avowés rendered
necessary for the commencement
of a Civil
suit.

True that parties
evidence may be elicited —
but this only
on special application.
