Preface

Of the present publication the one particular object is
the preserving the country from being saddled burthened by institutions
which under the profession sincere or insincere is sincere
of contributing to the formation of an appropriate Code of
Procedure will have the effect rather of rendering or even
preventing it, and at the same time adding to expence by
which no fruit in the shape of benefit will be produced

A Procedure Code fit to be applied by invoked with
the force of law would not be prepared found otherwise than by and
with reference to the body of a law Non penal and Penal and
Non-penal to which it has for its object and purpose the giving
execution and effect.

The present production publication asserted of following me before
is in the time of the publication antecedent to both these Codes. If applicable in other respects it will
not however be found in that account inapplicable in its intended
purpose. That which was necessary to its being so is
indeed a continual reference to the number of those several Codes
But in the mind of the author that references have
been made: and in the his as yet unedited writings if it is already
in a great print mode. For if the point had the plan
has long been formed and under all the several heads a more
or less considerable portion of the number committed is written
A sketch of the plan as exhibited by the titles of the several
Parts Chapters and Sections is accordingly here be subjoined

As to the Non-penal or say Civil Code as to whether any
part of the field of that branch of the law has been unserveyed
by the author a judgment may be formed from the first of
the work edited in French from his papers by M: Dumont, and from
the Article in the printed made the authors name in No 13 of the Westminster Review.
