The matter proposed to be employed being thus in the present proposed Code being given —
what remains to be shown is that, of the nature in the present English
Books of Practice as they are called, what has not been here employed, is
either simply useless non conducive or positively — abductive with
reference to the ends of justice.
For this purpose What presents itself as the most satisfactory
course is this. Fort the several principal judicatories,
take the respective most accredited
Books of practice, and setting down the heads to
which the several portions of matter present
themselves as referable, mark and take account
of the several pages and lines in which are contained
the quantities of matter regarded as superseded.
Note the number of pages in each such
book, together with the number of the pages so
disposed of, and regarded as superseded. Conclude
by taking the sum of the aggregate of the whole.
For the grounds and reasons of supercession
in each instance, find expressions, in the penning
of which, by single worded or other short appellations,
once for all defined or otherwise expounded,
compression and brevity or say conciseness, may
be maximized.
