General View

3Ends of Judicature.

8
Expence of pursuit
acts in prevention of
ungrounded suits

Art. 9 such is its tendency and such to pr a prodigious
degree is its effect, independently of all intention worth/endeavour and or so much as desire
on the part of the framers of the those by whom the system was framed
or those by whom application is made b of the powers established
by it. To the production of the result than for solution not only is no such
endeavour or desire necessary, but in spite of their most strenuous
endeavours to the contrary it could not be prevented from taking having
place.

9
But notwithstanding
this portion of good,
greater evils springing arising
from this source.

At the same time, which without and to the even universally indignant extent
without against any such intention the mass of hardship is pro
in this shape productive of good good effects, in another shape, it
is produ to an unmeasurable extent productive of evil effects.
it is an instrument put into the hands of the oppressor: of
every oppressor who is rich and wicked profligate enough to purchase
the use of it at the hands of those who according to the situation
of those by whom it was made, continue to their profit.
an instrument by which the single of were it not for the under the
yoke of one tenth of the population the other nine tenths are kept in
an oppressed state, and but for the salutary though scarce
perceptible influence of the Public Office Tribunal would
be kept in a state of the most abject

10
This evil the result
of intention on the part
of rulers.

That the evil on on the part of rulers the evil is every plan the
result not of oversight of deficiency no unblinkered applied
but of purposed intention and endeavour is matter of elimination. altogether out of doubt
For every where not only are the obstacles in question left
in full force without any endeavour to remove or lessen them,
but addition, and in a vast amount is made to their force: used
by two instruments of their own manufacture made by them with the
manifestly effect and hence with the undesirable unquestionable purpose.
namely low wages and low fees: low fees wages imposed by the rulers for that
of
of their own excessive
and for the abasement of
this maleficent power: low
fees which in their
legislate capacity
they
suffer their colleague and
instrument to exact for the encrease of their own wealth thus amassed by the application of oppression to the purpose of depredation.
