Sources of such expence in
1. Procurement of evidence where in the case where expence is explicitly
attached to the collection of it: namely if in the case
of oral evidence, expence of conveyance to and from the abode of
the intend witness proposed witness to and from the seat of judicature: 2 expence
of demurrage at the seat of judicature: and 2. loss of
time which to those to whom time is a an indispensable source
of subsistence is tantamount to expence; in the case of written
evidence expence of making the necessary transcripts and if at a distance
the expence likewise of conveyance

Blame by pursuit
with or defence with
consciousness of groundlessness
As to blame independently of that any which may have
had place at the origin of the suit on the part of the pursuer
pursuit accompanied with under the consciousness of its groundlessness —
on the part of the defendant or defence with the under the like consciousness of its
groundlessness, blame may have place on either side; and this
as well on the part of him who knows himself to be in the
wrong as on the part of him who being in the wrong knows
he is so. Such will be the case in so far as either side of the
cause, arrangements steps are taken having for their effect, whether
they have or have not had for their object the production of
needless vexation or expence on the part of the adverse opposite side.
