As to the provision of pecuniary punishment fine or other punishment for vexatious pursuit
or defence, if the security in this shape were not produced observe
the costs that could ensue.

Rule for minimization
of e vexation & expence
exception from an obligation
of personal appearance

For the purpose of incurring vexation and expence or rather
for the purpose of avoiding be created, create it — this
fundamental general rule is — except or excepted obligation
of the pursuer personal appearance at the judgment sent on the
part of all parties as well as witnesses

The Of the arrangement the necessity to justice will that is to say
to all the normal ends of justice will be still on. To the purpose
of the argument let it here be permanently assured.

Now then observe the consequence

in any number to
appear at any time
at the distance of any
person

Every person being compelled to appear in the place in
question at any time and then at all times at the instance of
any person or number of persons appearing in the character
of plaintiff no person preventable from appearing in that character
or punishable for the vexation produced as above with or
without concert on the part of a set of evildoers for this
purpose or even by a single such evildoer the whole life of any
person or of persons in an indefinite number might be compleatly
occupied by calls to this effect: a tyranny
over all then put into the hands of all: a tyranny and of
such sort as would have amongst other things effects that of a
to commit murder by cutting off from men in
any number the faculty means of continuing their existence
the means of ensuring their subsistence.
