Ch. 1. Relation to Substantive
(5 §.
16
Of Aberrations of existing
system the source in the
opposition of ends of
judicature the ends of justice
As to the aberration these aberrations by which the
course of procedure has been rendered a cause of such
afflictive intricacy they will be found all stringing from
one cau source; the opposition of the actual ends of judicature
to the ends of justice: the opposition between the
interests of those by whom with that course has been requited
and the interests of the people whose destiny has
been deprived of by it.

By this circumstance
every enormity accounted
for
By this one circumstance every enormity will be
seen to be accounted for: every thing object that occurs in these
several codes rendered plain and clear: without it, every
object will be obscure, the whole of it continues to present to
view the same chaos as at present.
18
In proposed system
course of procedure
delineated with a
continual eye to the
mass of substantive law.
Doubtless without a continual eye to the mass of
substantive law in all its branches no such outline of
the course of procedure as the present could have been
delineated: but if the yet in regard to the object which it was necessary
should be kept in view the writing by the writer it was not
necessary that they presented to the readers view of the reader.
