Provisional probation
on pursuers side

Under these circumstances, subject to these conditions
the allegation lives, to the purpose of warranting provisional execution
in a certain so shaped as not to be productive of irreperable
damage, the effect of probation, provisional probation, protective
to that effect, but r for the purpose of rending giving the provisional
execution to definite effect requiring to be subjected to the controul of
any such counter evidence as may be adduced by the defendant, as also
counterable in opposition to the evidence relative to the facts advanced
on the pursuers side together with evidence
of such facts if any such there be, the tendency of which is to disavow
and render of no effect any facts to which r it has
happened to be sufficiently established be the facts advanced
on the pursuers side

Intimate is the connection between these secret operations
necessary are all of them but one, to wit making bondsmanship
to the due honoration of every suit on the pursuers side

Order of bringing to view
1 Order of contemplation
2 Order of performance

In two opposite orders they are capable of being
brought to view. Order 1 order in which they are contemplated.
Order 2. the order in which they are performed

In the order in which they are contemplated they stand thus
1. Application, 2. execution — execution being the only object in
which the appellation is immediately deserted. 3. probation
having for its object the engaging the Judge to take means for
eventual execution: In consummate mode taken every
necessary action in the drama and every other so far as is
necessary for the bringing about the definite execution the which
every operation performed by the applicant pursuer, heeds:
together with the appropriate number of them performed by the
Judge.
