Art. On each several occasion to what judicatory
shall or may application be made? The answer is
short, and will naturally be satisfactory: to that judicatory
by the application to which the aggregate convenience of the main
parties may most effectively be constituted presented and provided
for

Where parties & subject
matter all in the
same judicial district
no difficulty has place

In that case which will always be of by far the
most frequent occasion no difficulty can have place. there is no room for difficulty. This is
where the residence of both or all parties is within the
boundary of the same judicatory: and the subject matter of the
suit has any real subject matter, also within that same boundary

Where parties resident
in different judicatories
producible

The only case in which any difficulty can present itself
is that in which the actual residence of the parti party applying
to be admitted pursuer is being in the of that same judicatory
the actual being also the habitual residence of other part —
more than one — copursuers or defendants is in the
of a different judicatory. The actual residence of each one
of them being at the same time capable of being different from
the habitual residence, here comes, by to ringing the changes
upon these differences the following different cases are producible
