Where antagonizing
lots of evil take magnitude
into the account
Art. Rule . When antagonizing two evils lots of evil considered as
liable to be produced the one on the pursuers side of the suit, the
other on the side Defendant's: two evils, both irreparable
or the evil on one side reparable, on the other side irreparable
forget not to take into account the magnitude or and value of each. in this case
On this occasion let not the magnitude be deluded by the
impressiveness of the idea attached to the word irreparable.
Loss though certainly irreparable to the amount of a shilling will may
not be to be guarded against with so much anxiety, as a
loss though perhaps reparable to the amount of a pound.

Art. . Rule . In a wrong-imputing yet
not penalizing penal private suit case the irreparable characteristic evil to be guarded excluded
against is deperition of the means of compensation or other means of satisfaction for the wrong execution in respect of
the service demanded by the pursuers not the charges of the
defendant's side

Art. Rule In a purely-public penal
suit the irreparable evil requiring to be guarded against for
the sake of the pursuers su side is the impunity of the
defendant in the case of his having been in the shape
in question a delinquent.

In every suit irreparable

Art. Rule In the every sort of suit the irreparable
evil, liable to the requiring to be guarded against for the sake
of the defendants side are 1. On erroneous or inadequate grounds
conviction and consequent correspondent burthen of compensation or punishment
or both imposed upon the defendant he not in truth not
having been guilty, not having committed the wrong imputed
to have or any other similar to it. 2. the evil composed of
the vexation and expence to which by means of the suit he may have
been subjected the evil correspondent and opposite to the collective
ends of justice.
