§. General rules for the guidance of the Judge in the exercise
of his the ulterior powers.

Judges first care the
fulfilment of the direct
ends of justice.
Art. 1. On each occasion, the direct and first
care and endeavour of the Judge will be the fulfilment
of the direct ends of justice to wit by giving doing that which/taking such course as in each individual
instance shall be most conducive to the fulfilment
of the direct ends of justice, positive and negative,
produce to wit the causing to be rendered when and in so far as due
the service demanded by the Pursuer.

Next do of the collateral
ends of justice
Art. His next care will be the fulfilment
of the collateral ends of justice: to wit by minimizing
on each occasion, the quantity of the evil in the its/the several shapes no
— delay, expence and vexation at large, to at the charge
of the descriptive classes of several persons in relation to whom his powers
will have to be exercised.

Where direct & collateral
ends outweighing
that to prevail which
will on the whole produce
the greatest good
Art. 3 When, and in so far as the direct collateral
ends of justice on the one part hand are seen to analogous with the direct
ends of justice on the other, it will be his care
to take pursue that course by which act is produced in the
least quantity by the taking of which the balance on the side of good is greatest
upon the whole.
