(2 §. General Rules

On all occasions judge
to make public declaration
of the reasons of
his proceedings.
Art. 4. On each individual occasion, as a security
for the maximization the aggregate of good, and the minimization
of the aggregate of evil, on that occasion he will pu
settle in his own mind and make public declaration of the
reasons by the considerations contemplation of which his conduct has been
determined guided: which reasons will count in the
of so many items on the account of evil on both sides: as
magnitude, propinquity and certainty or say probability and what
being in relation to each kind of good and evil taken into
the account.
Proportioned to the clearness with which these reasons
are concerned will be his own assurance and satisfaction
and assurance of the conformity of his proceedings with the
ends and dictates of justice, proportioned to the clearness with
which they are expressed will be the satisfaction afforded
to this the superordinate authorities in which to whom
he is responsible.

Art. 5. For these purposes, the Constitutional Code
on the principles of which this Procedure Code has been
grounded gives to his legal power a latitude to which in
general there are no fast limits: at the same time maximizing,
according to its his effective responsibility, and utmost endeavours the efficiency
multitude used assurances of the checks provided for the preventing these such his power
from being employed to any sinister purpose.
