4. Faculty for exacting at the charge of a person at the
charge of whom it is in contemplation to prefer a demand
for him and in relation to whom it is apprehended
and who it is apprehend is at the eve of departure from
the country in question to some spot on to which he can
not be made whose obedience as to the authority
of the not accessible to the person immediately or unimmediately
to the persons of the judicatory to the purpose of
efficient justiciability on his in relation to such demand
(a) In English law example of a suit having
for its object deperition of personal evidence. Suit for examination
in perpetuum rui memoriam.

In both instances the application of the applicability
of the remedy falls extremely short of the demand in respect
of its extent over the field of law and judicature: and in
neither instance is it afforded to any person who is not at
once able and willing to purchase buy it it of the Judge and his
pushers in trade and the expence of the most expensive of so
many sorts of expence — a suit in Equity.
