In a date of European civilization In English procedure neither without
consent, nor with consent though in an extraseated state even without consent vicarious
misseated punishment is resorted to, with consent
in the way of purely practical responsibility it can scarcely
be seen to be so in any case can it be seen to be so

Should a man say — should my friend fail to do what is required
at his hands, take me, committ me to prison and
keep me there till he does, for no such the acceptance of no
such offer would be found find a door left open by any where by
judicial practice: that is to say in unimmediate way: for in
an immediate way, as will presently be seen, this it has
been left open with but too much effect

In this case then what the only sort of security
that either in practice is given or ought to in fact to be given is that that which is given by self-subjection
above mentioned under the name of pledge-giving security to collateral responsibility in a/the compensational shape
as applied to subject matter properly at large.

This however does not amount to that mode of security
which has just been designated by the appellation of the pledge-giving
mode. Of an eventual debt the existence is indeed recognized.
But of this debt the money due by this debt the eventual recovery obtainment
is left to the same claims as it would be in the case of the
applicant of no such security as that which here in
question were afforded by him.
