Before calling for
Defendant's appearance
Judge will satisfy himself
as to concurrent justificative
or exempting circumstances
elicited

If the subject of application be a complaint be a wrong the definition
of the wrong will have informed the Judge of the extenuative
circumstances the union concurrence of which is necessary to the
constituting it existence of it. As need may occurr he will either mention
them to the applicant, or want for to pu collect them from the
applicant's statement as it comes out forth. And before
he determines to call for the appearance of a defendant, he
will in a like manner satisfy himself that according to the applicant's shewing no circumstances
of justification as of exemption relative to the species of offence
in question have had place.

If application a demand
Judge to have recourse
to table shewing rights
to demand services

If the application be the as above a demand,
the Judge will of course have in his mind the respective
natures of the several services capable of being demanded
without imputation of wrong on the part of those at whose
charge they are demanded: together with a list of all
the several efficient causes of title with respect to service
in all these several shapes. This being consigned to another
such Table as above will at the same time afford to the
applicant such information as the state of his mind enables
him to contrive.

circumstances exhibited

In the same Table in which are exhibited the several
incidents which with reference to a table of the sort of services in question
have a collective effect, will also exhibit in conjunction with
them the several circumstances which are con with reference
to that same object may have an ablative effect.

The same case which has been employed in the accounting
so far as depends upon the applicant's shewing the existence
of some one article in the list of collective circumstances will be employed
in
in ascertaining the non-existence
of all the
several collective circumstances.
