It must then be for the choice determination of the Judge to which
description of person application should first be made
whether to the applicant's posture in interest — to the applicant's
expected witnesses, or to the Defendant or Defendants.
and in such his determination he will of course be governed guided
by the joint considerations of delay vexation and expence:
regard being had to the importance of the case, on the one hand and the
probable quantity of dela unavoidable vexation and expence on the
other hand.
