Occurrence of a multiplicity
of supposed
wrongs on each side
Art. An occurrence naturally not infrequent as
this. Between the an applicant and a party complained
of, a series of wr supposed wrongs on both sides has
had place. In a case of this sort, if, on the occasion
of the application made on one side the judicial service
due to be rendered to the applicant, no notice being
at the same time taken of a any wrong attend done by
him to the proposed defendant, justice would be rendered
in appearance, in reality not.

Judge may be/may not to refuse to take
cognizance of all the
same day
As to the multitude of the individual instances
of wrong in the several shapes capable of being done
on one side by an individual to another, so neither there is no determinable
limit, so neither still less can there be to that of the
instances of wrong on both sides: Of no one
alledged wrong can the Judge refuse to take cognizance, any
more than of any other. By taki Whatsoever, in any
particular instance may be the number, if on the day of
the first application made by either of the parties cognizance
be taken of the whole series; judgment may
be pronounced on every one of them on that same day:
whereas if separate day be appointed for each, no limit
can be assigned to the quantity of delay which may have
place; delay to the suitors, with correspondent needless expenditure
of
of the time of the several
actors in the judicial
theatre.
